These Terms and Conditions apply when booking and/or taking driving lessons or sitting a driving test/driving assessment with Keiran Williams, Access Driving. Please read them carefully and raise any questions you may have before taking your first lesson.
Lesson Tuition
Lesson Tuition is only available to persons aged 17 or over (or aged 16 if in receipt of the higher rate element of the disability living allowance or personal independence payment) and who hold a driving licence valid in the UK (provisional or full), or fulfil the Section 88 criteria and who are legally entitled to drive in the UK. You must be able to read a number plate at 20 metres.
Keiran Williams, Access Driving are only able to provide an automatic tuition vehicle. This vehicle is fitted with the following adaptions: push/pull hand controls, left foot accelerator, steering spinner, secondary steering control. Keiran Williams, Access Driving is happy to teach in the pupil’s own manual or specially adapted vehicle, (see “Lessons in your vehicle”)
Lessons
The standard lesson is of a two-hour duration, which is charged at a set rate. This is the standard advertised rate. Shorter lessons are available; however these will be charged at a different hourly rate. Longer lessons will be charged at the standard rate, but dependent on length, may also include a rest break. The current lesson rate can be found on the Access Driving website.
Your responsibilities.
It is your responsibility to ensure that you have the appropriate licence. This must be presented to your Driving Instructor prior to the commencement of your tuition. (if driving on a PDAL you must show the instructor the accompanying letter from DVLA Medical). Your Instructor reserves the right to refuse to provide you with lesson tuition or to cancel any lessons you have agreed to or booked, without liability, if you fail to provide them with the licence prior to your first lesson, or you are unable to read a number plate at 20 metres.
If driving with a medical condition or disability this, if notifiable, must have been reported to the DVLA (a full list of notifiable medical conditions and disabilities can be found on the .gov website). If your health changes, or a doctor or a medical professional informs you not to drive you agree to tell Keiran Williams, Access Driving and inform the DVLA if necessary. Failure to report a medical condition or disability to the DVLA may invalidate your driving licence thus also invalidating the insurance covering the lesson. In this case you will be liable for all losses to all parties.
It is your responsibility to be ready for your lesson on time and at the agreed pick-up location (see “Not turning up for a lesson”). You must be in a fit state for the lesson (see “Drink, drugs and medication”) and appropriately attired, with appropriate footwear.
You must get permission from the Instructor to change pick up or drop off points from your lesson in advance. If this change affects the travel time of the instructor, then the extra time it takes to get to you or to the next lesson will come out of your allotted lesson time to ensure the next pupil is not adversely affected.
If you wish to have another person in the car during lessons, this must be agreed in advance with the Instructor.
The paying of any penalty notices, and any points endorsements for speeding or other motoring offences are the responsibility of the driver.
Our responsibilities
Keiran Williams, Access Driving will provide training on a one-to-one basis with no other learner in the car. We will provide an automatic duel-controlled car, fully insured for the use of driving instruction. Tuition vehicles are fitted with cameras (“Dash Cams”) recording continuously for insurance purposes.
We will endeavour to be on time at the agreed pick-up point and be available for the full duration of the lesson booking, subject to any circumstances beyond our control. We will endeavour to give you two working days’ notice (excluding Bank Holidays) should a lesson need to be rescheduled.
The Instructor is a fully qualified DVSA, Approved Driving Instructor (ADI) with DBS in place, issued by the DVSA as part of the Instructors’ ADI status.
Payment
Lessons are to be paid for in advance, preferably directly by bank transfer. Payment may be made by cash by prior agreement. If payment is not received prior to the lesson, the Instructor reserves the right to cancel that lesson, in which case the pupil will still be liable for the full lesson fee. Enforcement action may be taken to recoup any unpaid fees.
Receipts are available, please ask the Instructor for a receipt for your lesson payment.
Payment by invoice can be arranged. Invoices must be paid within 30 days. Late payment will accrue daily interest charged at the “Statutory Interest Rate”.
Pre-Paid Lesson Discount
Pre-Paid Lesson Discounts are available for “Standard” 2 hour lessons. Discounts are offered for blocks of 5 lessons (ten hours tuition) and 10 lessons (twenty hours tuition). Payment must be received, in full, before the first lesson of that block or the lesson will be charged at the standard hourly rate. The current lesson rate can be found on the Access Driving website.
Shorter duration lessons do not qualify for Pre-Paid Discount.
The Practical Diving Test does not qualify for Pre-Paid Discount and is charged at the set rate (See “Booking and taking of Practical Driving Test”).
Lessons must be taken within 6 months of payment being made.
Refunds for pre-paid lessons
Refunds are only available for lessons that have not been taken or booked. Lessons taken will be charged at the “standard rate” not the discounted pre-paid rate.
Untaken pre-paid lessons can be refunded up to 6 months from the date of payment. After 6 months payment is forfeited and non-refundable.
A request for a refund must be made in writing and sent by post or email.
The refund will be the remaining balance after the standard rate has been applied minus £20.00 administration fee for time to process the refund.
Refunds will be paid in the form of a bank transfer or cheque.
Offers
From time to time there may be special offers available via the website, or directly from the Driving Instructor. These may not be used in conjunction with a block booking reduction.
Lesson Cancellation Policy
You must give your Instructor at least 48 hours’ notice if you wish to cancel or rearrange a driving lesson, otherwise you will be liable to pay for 100% of the lesson fee.
If the Instructor needs to cancel lessons due to unsafe driving conditions, unavailability of a suitable vehicle, or illness he will endeavour to give you as much notice as possible.
If the instructor feels that the weather conditions become unsafe during the course of the lesson the Instructor reserves the right to end the lesson at that point. You will only be charged for the duration of the lesson up to the point that conditions became unsafe to carry on.
Not turning up for lesson
If you do not turn up for a lesson the Instructor will try to telephone you to check what has happened. If he cannot contact you he will wait for 15 minutes at the collection point, if safe and legal to do so. The full fee for the missed lesson will be due.
You want to stop lesson early
If you wish to stop a lesson part way through, the full fee for that lesson will still be due.
Booking and taking of Practical Driving Test
The theory test must have been passed and still within date to book a Practical Driving Test. The booking of the Practical test must be done in conjunction with the Driving Instructor to ensure diary availability and your anticipated test readiness.
It is your responsibility to pay for the test to the DVSA, which is separate to the fee liable to the Driving Instructor.
A minimum three-hour lesson fee will be due for a practical test, unless taking an extended test or you are eligible for and receive extra time. In this case the test will be charged at the door-to-door duration. The test lesson fee includes pre-test tuition, the duration of the test and return of pupil to the agreed drop-off point. The Practical Driving Test is charged at a set rate and pre-paid discounts do not apply.
The Instructor reserves the right to refuse use of his car if he feels that you are not ready to drive on your own, if this is within the DVSA non-refundable cancellation period the Driving Instructor will not be liable for the cost of the lost test fee. In the unlikely event of this happening the Driving Instructor will not request payment for his time booked for the test.
If the DVSA cancel the test at short notice you must pay for the time booked for the test with the instructor. The Instructor will then support you in claiming compensation from the DVSA.
Booking and taking of a driving assessment
If you wish your Driving Instructor to attend the assessment, the booking of the assessment must be done in conjunction with your instructor to ensure diary availability and your anticipated readiness.
It is your responsibility to pay for the test to the assessment body, which is separate to the fee liable to the Driving Instructor.
A minimum three-hour lesson fee will be due for a assessment. Where travel time or the assessment process will be of a longer duration this will be charged at the door-to-door duration. The fee includes pre-assessment tuition (where appropriate), the duration of the assessment and the return of pupil to the agreed drop-off point. The assessment is charged at a set rate and pre-paid discounts do not apply.
When asked by the DVLA or assessment organisation the instructor will write a report on your lessons and the standard of your driving. This will be an honest assessment covering both positive and negative aspects of the standard of driving observed on lessons. The instructor will only recommend a driver receives a licence where the instructor believes the driver is a at safe standard and that this has been consistently demonstrated on lessons.
If the DVLA or assessment organisation cancel the assessment at short notice you must pay for the time booked for the test with the instructor. The instructor will then support you in claiming compensation from the DVLA or assessment organisation.
Lessons in your vehicle
In certain circumstances lessons may be carried out in your vehicle. If so, your insurance will cover the lesson. The Instructor must see proof of insurance before lessons commence. For learner drivers the instructor will require dual controls to be fitted.
For the car to be driven by the Instructor, the instructor must be added to your insurance at your cost. Lesson prices in your vehicle will be the same as those delivered in one of our cars.
Drink, drugs and medication
If the Driving Instructor suspects that you may be in an intoxicated state then they reserve the right to refuse to take the lesson, or terminate it at any point. You will be liable for the full lesson fee. The Instructor also reserves the right to refuse any further tuition, any lesson pre-payment would also be forfeited in this case. If not pre-paying, you will be liable to pay for any lessons booked for four weeks from the date of the infraction. The police will also be informed if the Instructor suspects that any laws have been broken.
